Does Pennsylvania have a homestead exemption?

No, Pennsylvania is one of only 3 states in the USA that does not have a homestead exemption (The other two are New Jersey and Maryland). However, in Pennsylvania you have the option of choosing to use the Federal Bankruptcy Exemptions. The federal bankruptcy exemptions currently offer a $20,200 homestead exemption – which doubles ($40,400), if you file together with your spouse.

If you have significant equity in your home and you are filing together with your spouse, then you will most likely want to choose the federal exemptions over the Pennsylvania State bankruptcy exemptions list.

However, the best option is still if you can avoid including your spouse in the bankruptcy filing. Because Pennsylvania law follows the concept of tenancy by the entirety, your home would only be included in the bankruptcy estate if you both file together.
